The Trademark Clearinghouse (TMCH) is the most important rights protection mechanism built into ICANN’s new gTLD program. Operators of new gTLDs will be responsible for implementing certain rights protection mechanisms, supported by the Trademark Clearinghouse. The Clearinghouse allows brand owners to submit their trademark data into one centralized database, prior to and during the launch of new gTLDs.

  • TMCH could offer trademark holder two main functions:

Sunrise service is an initial period of at least 30 days before domain names are offered to the general public. Trademark owners can take advantage of the Sunrise to safeguard the domain name that matches their trademark. A Sunrise Period is mandatory for all new gTLDs and having a validated trademark entry in the Clearinghouse is the minimum requirement to participate in this limited pre-registration period, also can avoid submitting trademark data repeatedly.

Claim service follows the Sunrise. It is a notification service when:
  • A potential domain name registrant gets a warning notice when attempting to register a domain name that matches a trademark term in the TMCH.
  • If, after receiving and accepting the notice, the domain name registrant does continue to register the domain name, the trademark holder with a corresponding mark will receive notification of the domain name registration, so they can take any appropriate action if they would like to.

  • To register a trademark in TMCH, you need to submit:
  1. Scanned copy of the certificate of TM
  2. Net-Chinese - TMCH Application Form
  3. Proof of use(example) & Signed Declaration
  4. Letter of Authorization

*Additional documents will be needed if the circumstances below are applicable:
  1. Proof of trademark extended: If the period a client wants to register for is longer than his TM’s period of validity, a proof of trademark extended is needed.
  2. Letter of Authorization of Trademark Use: If the applicant is a Licensee or an Assignee (if the ownership of the TM is in the process of transfer, the new owner of the TM is an Assignee), the applicant will need to provide the declaration based on the type of TM.
Three types of TM are:
  • Mark protected under statute or treaty
  • Court validated marks
  • Registered Mark

In other words, the declaration will have 6 versions depended on the applicant’s identity (please refer to the file ”Additional docs”) :
  • Assignee Declaration - Mark protected under statute or treaty - v1
  • Assignee Declaration - Registered Mark - v1
  • Assignee Declaration-Court validated marks
  • License Declaration-Court Validated
  • License Declaration-Mark protected under statute or treaty
  • License Declaration-Registered Trademark

  • Once we receive the necessary documentation and the fees, we will proceed registering TMs in TMCH.
According to TMCH, a review will possibly take 1 – 3 months, during which if supplementary documents are needed, they will inform the registrant. In our case, we will inform you of the notice instead of contacting your clients directly.
